摘　　要：平等是社会主义法律的基本价值,是法理论关注的重要议题。新中国法律平等理论发展,与国家从站起来、富起来到强起来的奋斗历程同频共振、互动共生。“五四宪法”确立“公民在法律上一律平等”原则,法律平等研究初渐,虽是阶级话语下的论争,但“何者面前、谁的平等、如何平等”的论题意识清晰化。改革开放新时期,再议“法律面前人人平等”“公民在法律适用中一律平等”成为当时的通说。90年代后,市场经济呼唤立法平等,法治现代化要求具化平等以关怀实践。新时代以来,研究转向实质平等,关注技术变革、人类命运共同体中的法律平等。当前我国发展不平衡、不充分,世界发展不平等、不稳定,法律平等研究将既深窥本土又放眼国际;既抽象演绎又具象关怀;既宏大叙事又精细化论证。Equality is the fundamental value of socialist law and an important topic of legal theory.The development of the theory of legal equality in New China resonates and interacts with the country’s struggle from standing up and becoming prosperous to becoming strong.The“May Fourth Constitution”established the principle of“citizens being equal before the law,”marking the initial emergence of the study of legal equality.Although it was a debate under the discourse of class,the consciousness of the issue“before whom,whose equality,and how to achieve equality”became clearer.In the new era of reform and opening up,the discussion on“equality before the law for all”and the idea that“citizens are equal in the application of the law”became prevalent.In the 1990s,the call for legislative equality emerged with the advent of the market economy,and the modernization of the rule of law demanded the actualization of equality to care for practice.Since the new era,research has shifted towards substantive equality,focusing on legal equality in technological changes and the global community of human destiny.Currently,China’s development is uneven and insufficient,and world development is unequal and unstable.Therefore,the study of legal equality will investigate the domestic as well as international aspects,encompassing both abstract deduction and concrete care,and ranging from grand narratives to meticulous argumentation.
