摘　　要：经过长期的宪法变迁,宪法生态环境条款已经形成了包括人权条款、思想理念条款、国家义务条款、组织保障条款在内的较为完整、系统的规范体系。对这一规范体系的认识必须遵循整体性与关联性的原则,不仅要在整体上充分认识生态环境条款规范内涵的历史发展性,也要充分解读生态环境条款内部各要素的侧重点以及各要素之间的内在逻辑。在公民环境权经由人权条款实质确认的背景下,公民环境权在规范层面构成生态环境条款的最终价值指向,推进生态文明建设和美丽中国国家目标的历史进程也就是公民环境权逐渐实现的过程。由此,推进生态环境条款的实施,根本路径是以宪法生态环境条款为指引构建有利于推进生态文明和美丽中国建设进程的生态环境治理制度体系,特别要注重形成持续凝聚全社会生态文明普遍共识的机制、不断构建绿色政绩制度、完善并强化检察环境公益诉讼保障职能。After long-term constitutional changes,eco-environment provisions of the Constitution have formed a relatively complete and systematic standard system,including human rights clauses,ideological clauses,state obligations clauses and organizational guarantees clauses.The understanding of this normative system must be directed by the principle of integrity and relevance,not only to fully understand the historical development of the normative connotation of the eco-environment clauses on the whole,but also to fully interpret the focus of the elements within the eco-environment clauses and the internal logic between the elements.Against the background of the substantive confirmation of citizens’environmental rights through the human rights clause,citizens’environmental rights constitute the ultimate value direction of the eco-environment clause at the normative level,and the historical process of promoting the construction of ecological civilization and the national goal of beautiful China is also the process of the gradual realization of citizens’environmental rights.Thus,to promote the implementation of the ecological environment clause,the fundamental path is the constitution of the eco-environment clause as the guidance to promote ecological civilization and beautiful China construction of eco-environment governance system,and attention should especially be paid to forming a universal consensus mechanism within the whole society,to constantly building a green achievement assessment system,and to improving and strengthening the procuratorial function in environment public interest litigation processes.
