权利贫困视角下城市困境儿童的福利权实现研究--基于J省四个城市的调查

摘　　要：实地调查发现,城市困境儿童福利权在一定程度上得到了保障,但仍存在散居困境儿童基本生活保障不足、医疗救助政策覆盖面窄、康复扶持发展不均衡、教育帮扶支持失衡等问题。城市困境儿童福利权实现受阻的主要原因是福利权贫困,具体表现为福利权实现程度较低、福利政策落实受阻、福利权缺乏稳定的法律保障。因此,应从福利权“脱贫”角度建立城市困境儿童福利权“脱贫”的社会保障制度,建立以平等价值为原则,以满足儿童需要为目标,由多元福利供给主体分工配合,以儿童福利权实现为评估标准的城市困境儿童组合式普惠型福利制度,切实保障城市困境儿童福利权的实现。This field investigation has revealed that although vulnerable children are guaranteed certain welfare rights,there are still such as insufficient basic living security for scattered children in need,limited policy coverage for medical assistance,uneven development of rehabilitation support,and unbalanced support for educational assistance.The primary obstacle to realizing the welfare rights of urban children in distress is the poverty of welfare rights,which is manifested in the low degree of realization of welfare rights,the obstruction of the implementation of welfare policies,and the lack of stable legal protection of welfare rights.To address the poverty of welfare rights,a social security system should be established from the perspective of“poverty alleviation”based on the principle of equal value and the goal of meeting children’s needs.The division of labor and cooperation of multiple welfare supply entities should be based on the realization of children’s welfare rights.Furthermore,it also calls for an evaluation standard that effectively guarantees the realization of the welfare rights of vulnerable children through a universal welfare system.
