摘 要:平台型企业由于本身具有双边市场的特征,导致传统应用于单边市场的反垄断竞争调查范式难以适应.为了优化和补充平台型企业的竞争调查范式,在总结平台型企业市场力量的来源和标志的基础上,考虑非价格竞争,从内部因素,外部因素和市场行为三个方面构建了一套平台型企业垄断判定指标体系,并应用此指标体系对数字购物平台企业垄断情况进行了打分,最终发现数字购物平台企业的垄断阈值在61.06与59.18之间.最后,考虑到目前平台型企业反垄断存在的问题,以及当前的国际反垄断形势,从监管体系和监管平台构建、非价格竞争、跨境经营方面提出了反垄断政策优化的建议.Digital platform enterprises have the characteristics of bilateral market,which makes the traditional anti-monopoly competition investigation paradigm applied to unilateral market dificult to adapt.In order to optimize and supplement the competition investigation paradigm of platform based enterprises,this article summarizes the sources and symbols of market power of platform based enterprises,considers non price competition,constructs a set of platform based enterprise monopoly determination indicator system from three aspects:internal factors,external factors,and market behavior,and applies this indicator system to score the monopoly situation of digital shopping platform enterprises,Finally,it was found that the monopoly threshold of digital shopping platform enterprises was between 61.06 and 59.18.Finally,considering the problems existing in the current digital platform anti-monopoly and the current international anti-monopoly situation,this paper puts forward suggestions on the optimization of anti-monopoly policy from the aspects of the construction of regulatory platform,non price competition and cross-border operation.
