摘　　要：随着人工智能、大数据、物联网、区块链等新技术新工具的迭代升级,算法时代或数字时代给新闻行业带来前所未有的深刻变革和影响。在此背景下,数据新闻所处的媒介生态和技术条件发生嬗变,其本身的新闻模型、采编流程、主体、内容和技术等均呈现新的特点。这些变化必然导致数据新闻在原有法律规制体系适用中产生一定的冲突或缺位,必须在与算法技术同频共生和相关法律关系调整之中,探寻破解法律适用与新闻采编流程再造以及法社会关系冲突的可行机制或路径。The algorithmic or digital era driven by the iterative advancement of new technologies and tools such as artificial intelligence big data the Internet of Things and blockchain has brought unprecedented and profound changes to the news industry affecting its media ecology and technical conditions.Consequently data journalism now exhibits new features in its news model editing process subject content and technology.However these changes also pose challenges or gaps for the existing legal and regulatory frameworks that govern data journalism.Therefore it is imperative to explore new path to reconcile legal application with the reconfigured news gathering process and legal-social relations which requires adjusting technology and law to suit the new situation of the algorithm era.
