司法解释视角下妨害国(边)境管理罪适用问题研究  

On the Application Issues of the Crime of Obstructing the Management of National (Territory) Borders from the Perspective of Judicial Interpretation

摘　　要：妨害国(边)境管理罪数量的增加要求完善相关法律法规体系,以遏制犯罪势头的增长。2022年6月发布的《关于依法惩治妨害国(边)境管理违法犯罪的意见》,与2012年12月发布的《最高人民法院、最高人民检察院关于办理妨害国(边)境管理刑事案件应用法律若干问题的解释》相比,在责任主体方面,将公安部、国家移民管理局增加确立为发布者;在适用对象方面,将国内外犯罪组织均囊括其中;在犯罪认定方面,阐述了有关妨害国(边)境管理罪的共同犯罪和犯罪的未完成形态。未来,针对妨害国(边)境管理罪的规制,要细化相关规范,构建信息网络,建立专职警务,为深入研究中国妨害国(边)境管理罪的发展提供新的思路和理论支持。The increasing numbers of crimes of obstructing the management of national(territory) borders have highlighted the urgency of improving the relevant legal and regulatory systems to curb the growth of this crime.In June 2022,the Opinions on Lawfully Punishing Violations and Crimes Obstructing the Management of National(Territory) Borders was issued.Notable changes can be observed in comparison with the Interpretation by the Supreme People's Court and the Supreme People's Procuratorate on Several Issues Concerning the Application of Laws in Handling Criminal Cases Involving Obstructing the Management of National(Territory) Borders,issued in December 2012.In terms of responsible entities,the Ministry of Public Security and the National Immigration Administration were additionally added as publishers.Regarding the applicable objects,both domestic and international criminal organizations were included.In terms of criminal identification,the joint crimes and unfinished forms of crimes related to the crimes of obstructing the management of national(territory) borders are elaborated.To regulate this crime in the future,it is deemed necessary to refine relevant norms,construct information network,and establish dedicated law enforcement,so as to generate new insights and theory supports for in-depth research on the crimes of obstructing the management of national(territory) borders.
