摘　　要：《公共图书馆法》经历了艰难曲折的立法进程。落实《公共图书馆法》规定的主要进展是:指引了公共图书馆发展的中国道路,县域公共图书馆总分馆制框架基本形成,公共图书馆设施网络建设取得突破性进展,建立了馆藏文献信息处置规范和年报制度,地方立法细化法律原则规定。落实《公共图书馆法》规定存在的主要问题是:县级以上人民政府设置公共图书馆的责任问题,省级人民政府文化主管部门及时公布本行政区域内公共图书馆信息的责任问题,公共图书馆在国家法定节假日“应当有开放时间”规定的落实问题。新时期应以新思路强化普法、用法、执法,包括贯通公共文化“二法”,衔接相关法律规定;推动“二法”普法进入各级党委理论学习中心组学习体系;完善法律执行、落实的机制与手段。Public Libraries Law of the People's Republic of China(Public Libraries Law)has gone through a difficult and tortuous legislative process.The main progress in implementing the Public Libraries Law is that it has guided the Chinese path of public library development,basically has formed the framework of the central-branch system of county public libraries,has made breakthroughs in the construction of public library facilities network,has established the standard for the disposal of collection literature information and the annual report system,and has detailed legal principles and provisions in local legislation.The main challenge in the implementation of the Public Libraries Law is the incomplete fulfillment of the provisions,including the responsibility of the people's governments at or above the county level to set up public libraries,the responsibility of the competent departments for culture of provincial-level people's governments to promptly publish public library information within their administrative areas,and the implementation of the provision that public libraries shall have opening hours on national statutory holidays.In the new era,we should strengthen the popularization,application and enforcement of the law with new ideas,including connecting the Public Libraries Law with Public Cultural Service Guarantee Law of the People's Republic of China,while matching with relevant legal provisions;promoting the popularization of the“two laws”into the educating system of the theoretical study center group of party committees at all levels;improving mechanisms and means for law enforcement and implementation.
