司法社工介入涉罪未成年人观护帮教实务研究——以服务对象小N为例

摘　　要：犯罪日趋低龄化的背景下,结合法律对涉罪未成年人一贯坚持的“教育为主、惩罚为辅”原则,越来越多的检察机关针对特定罪名、罪行较轻且有悔罪表现的未成年罪犯做出附条件不起诉决定,这体现了由传统的刑事惩罚性司法模式向现代的恢复性司法模式的转变。附条件不起诉制度的核心工作是对考察期内的涉罪未成年人进行监督和矫治,此过程中司法社工的参与不可或缺。本文以个案小N为例,介绍分析司法社工在涉罪未成年人观护帮教服务中的作用,发现司法社工在实际服务开展中面临诸如专职司法社工人员配备不足、帮教服务过程可用资源有限、帮教计划实施不确定因素多等问题。可通过加强司法社工培养,扩充司法社工队伍;改变单一资金来源,增加多种资源投入;完善风险预案机制,构建完备应急体系等方式,改善司法帮教服务质量。In the context of the increasingly younger age of criminals,and in conjunction with the principle of“education first with punishment as a supporting approach”that the law has always upheld with regard to minors involved in crime,more and more procuratorial organs are making conditional non-prosecution decisions for minors who have been convicted of specific crimes and less serious offences and who have shown signs of remorse for their crimes,with specific charges lighter crimes and signs of repentance for their crimes,which reflects a transformation from the traditional model of criminal punitive justice to the modern model of restorative justice.The core work of the conditional non-prosecution system is to supervise and correct minors involved in crimes during the investigation period,and the participation of judicial social workers is indispensable in this process.This article takes the case of Xiao N as an example to introduce and analyze the role of judicial social workers in the care and education services for minors involved in crimes,and finds that judicial social workers face problems such as insufficient staffing of full-time judicial social workers,limited resources available in the education service process and many uncertain factors in the implementation of education plans in actual service delivery.The quality of judicial assistance and education services can be improved through the methods such as strengthening the training of judicial social workers to expand the team of judicial social workers;changing the single source of funding and increasing the input of multiple resources;and improving the risk prevention mechanism and building a comprehensive emergency management system.
