摘　　要：在清末变法修律的过程中,法理派和礼教派就《大清新刑律》的制定展开了激烈的争论。法理派主张司法独立、实体法与程序法分离并剔除封建礼教,礼教派认为应当维护地方督抚的裁判权、实体法为体诉讼法为用以及“因伦制礼,准理制刑”。袁世凯在此次礼法之争中对法理派给予强有力的支持,法理派在人数远少于礼教派的情况下取得了胜利。袁世凯法制改革思想与沈家本相通之处颇多,支持法理派与其对“西学”“西法”的认同密不可分。但是,袁世凯成为法理派的同盟是出于自身利益的考虑,他担心慈禧去世后对其不满的满洲贵族会借机报复,支持法理派可以在一定程度上限制皇权。In the process of law amending in the late Qing Dynasty,the law factions and the ritual religious sects had a heated debate on the formulation of The New Criminal Law of Qing Dynasty.The law factions advocates the independence of the judiciary,the separation of substantive law and procedural law,and the elimination of feudal ethics,and the ritual religious sects believes that the adjudication of local governors should be maintained,and that the substantive law should be used as the body of the procedural law,and“ethics govern etiquette,and quasi-reason governs punishment”.Yuan Shikai gave strong support to the law factions in this dispute over the courtesy law battle,and the law factions won in a far fewer number than the ritual religious sects.Yuan Shikai’s thoughts on legal reform have many similarities with Shen Jiaben’s,and his support for the law factions is inseparable from his identification with“Western learning”and“Western law”.However,Yuan Shikai became an ally of the law factions because of his own interests,and he was worried that the Manchu nobles who were dissatisfied with Cixi would take the opportunity to retaliate after Cixi’s death,and supporting the law factions could limit imperial power to a certain extent.
