判定犯罪中止自动性影响要素刍议

摘　　要：犯罪中止的自动性作为人的主观行为在司法实践中的判断需要完善的理论支撑,目前有三种主流学说,主观说、客观说、折中说,但此三种学说在实践中由于缺乏客观标准,忽视了人的主观差异性而受到阻碍。根据客观事实发生的变化克服了主观价值实现了自我行为调整的主观价值生活说可以成为自动性的判定思路,并提出时间、空间、工具、实现方式等条件转变假设,进一步提出结合主观说、弗兰克法则、主观的价值生活说三种理论的阶梯型思路,该思路能够适应中止犯在客观因素变化后的自动性判断。The automaticity of the discontinuance of a crime as a subjective act of a person’s judgement in judicial practice requires sound theoretical support,and at present,there are three mainstream theories,namely,subjective theory,objective theory and compromise theory,but these three theories are hindered in practice because of the lack of objective standards and the neglect of human subjective differences.The subjective value life theory,which overcomes the subjective value and realizes the self-behavior adjustment according to the changes of objective facts,can be an automatic judgment idea,and puts forward the assumptions of conditional transformation such as time,space,tools and realization methods,and further puts forward a step-by-step idea combining subjective theory,Frank’s law and subjective value life theory,which can adapt to the automatic judgment of the discontinued offender after the changes of objective factors.
