摘 要:在网络游戏同质化越来越严重的背景下,如何对网络游戏规则进行有效保护,是关系到网络游戏市场能否良性发展的核心问题。网络游戏规则是一个复杂的整体概念,随着科学技术的不断发展,复杂、具体的游戏规则可能构成表达。但是分析网络游戏规则的可版权性,并不是认为所有的网络游戏规则都可以受到著作权法的保护,仍然要理清网络游戏规则的保护范围。以思想表达二分法为基础,结合司法裁判现状进行分析总结,探究网络游戏规则著作权保护的范围和具体路径时,需考虑三点:(一)计算机软件作品保护力度低;(二)文字作品保护范围较小;(三)视听作品的保护具有一定合理性。Under the background of increasing homogenization of online games,how to effectively protect the rules of online games is the core issue related to the benign development of the online game market.Online game rules are a complex overall concept,with the continuous development of science and technology,complex and specific game rules may constitute the expression.However,the analysis of the copyrightability of online game rules does not mean that all online games rules can be protected by the copyright law,and it is still necessary to clarify the scope of protection of online games rules.Based on the dichotomy of thought expression,combined with the analysis and summary of the current situation of judicial decisions,and when exploring the scope and specific path of the copyright protection of online game rules,it is necessary to take into account the following three points:(1)the low protection of computer software works;(2)the relatively small scope of protection of written works;(3)a certain degree of reasonableness for the protection of audio-visual works.
