绿色发展理念在环境法典中的逻辑定位及体系回应

摘　　要：绿色发展理念在推动生态文明建设、统筹“人与自然”的关系、坚持系统治理思维等方面,可为环境法典编撰提供政治引领、路径依赖的作用,可以将其作为可持续发展展开的路径与适用方法。经由环境法典编撰对绿色发展理念的话语转化和规范表达,绿色发展理念的生态系统观、整体观和减污降碳协同增效法律体系将融入环境法典,并最终形成绿色发展格局。In terms of promoting the construction of ecological civilization,coordinating the relationship between"man and nature",and adhering to the thinking of systematic governance,the concept of green development can provide political guidance and path-dependent role for the compilation of environmental code,and can be used as a path and applicable method for sustainable development.Through the discourse transformation and normative expression of the green development concept in the compilation of the environmental code,the ecological system view,the holistic view and the legal system of the synergistic effect of the green development concept will be integrated into the environmental code,and finally form the green development pattern.
