摘 要:智能量刑系统在司法应用实践中主要面临三方面的难题:其一,智能量刑系统的运行面临程序缺陷问题;其二,智能量刑系统与法官之间的关系界定模糊;其三,智能量刑系统面临着判决结果的可接受性困境。通过分析实践难题并借鉴域外经验,提出建立智能量刑系统的质量审查机制、构造智能量刑辅助法官审判的刑事司法模式以及保障当事人的算法选择权和知情申诉权等三项措施。As a new thing involved in the judicial procedure,intelligent sentencing system helps to solve the problem of"dfferent treatment for the same case"and improve judicial efficiency,but it also exerts an impact on judicial system.The intelligent sentencing system mainly faces three challenges in judicial application practice.Firstly,the operation of the intelligent sentencing system faces program defects.Secondly,the relationship between intelligent sentencing systems and judges is blurred.Thirdly,the intelligent sentencing system faces the dilemma of acceptability of judgment results.This article proposes to establish a quality review mechanism for intelligent sentencing systems,construct a criminal justice model for intelligent sentencing to assist judges in trial and safeguard the parties'right to algorithm selection and informed appeal through analyzing practical difficulties and drawing on foreign experience for legal responses.
