摘　　要：《民法典》第1001条首次规定身份权利,对身份权利的保护采适用与参照适用的双层立法设计,从而为身份权利提供了参照人格权保护的可能性与延展性,进一步完善了法典背景下的身份权利保护。准确的适用《民法典》第1001条,发挥其原有的立法目的与价值,核心在于对身份权利保护的“参照适用”进行释义。首先应对身份以及身份权利的《民法典》理解进行明确,理清《民法典》中身份权利的内涵。其次应遵循法条原意,在适用位阶上,对能够直接适用身份权利保护的法律规范进行梳理;最后在严格恪守法条文义中“根据其性质”的参照适用要求时,辅以身份权利所具有的价值意蕴综合进行人格权编“参照适用”的规范性考量,以期达到《民法典》完善身份权利保护的立法初衷。Article 1001 of the Civil Code provides for the protection of identity rights for the first time,and adopts a two-tier legislative design of application and reference to the protection of identity rights,thus providing the rights of identity with the possibility and extension of application protection by reference to the rights of personality,further improving the protection of identity rights in the context of the Code.The core of the accurate application of Article 1001 of the Civil Code,which brings into play its original legislative purpose and value,lies in the interpretation of the“application by reference”of the protection of identity rights.Firstly,it is necessary to clarify the understanding of identity and identity rights in the Civil Code and to clarify the meaning of identity rights in the Civil Code.Secondly,the original intent of the law should be followed,and the legal norms that can be directly applied to the protection of identity rights should be sorted out in terms of the level of application;finally,while strictly adhering to the requirement of“in accordance with its nature”in the definition of the law,the value implication of identity rights should be supplemented with the comprehensive“application by reference”of the codification of personality rights.In the end,while strictly adhering to the requirement of“in accordance with its nature”in the text of the law,the normative consideration of the“reference application”of the personality rights codification is supplemented by the value implication of the identity rights,with a view to achieving the original legislative intent of the civil code to improve the protection of identity rights.
