摘 要:随着我国经济的突飞猛进,现代物流行业迎来前所未有的发展机遇。然而,我国传统的第一方物流和第二方物流行业,其组织和管理模式已经无法满足当今社会对物流的多元化需求。于是,第三方物流行业应运而生,相比传统物流,它更加专业化,针对性更强,运作成本也不高,效率也得到提高,同时也符合现代物流业的发展趋势。但是第三方物流也存在很多问题,其主要原因是缺乏法律方面的监管,而且对这一方面的研究也是少之又少,所以针对第三方物流建立监管法律制度已经迫在眉睫。文章首先介绍我国第三方物流的概念和特点,之后对第三方物流监管方面存在的问题进行分析,最后提出相对合理的治理路径。With the rapid development of China's economy,the modern logistics industry has ushered in unprecedented development opportunities.However,the traditional first-party logistics and second-party logistics industries in China are no longer able to meet the diversified needs of logistics in today's society through their organizational and management models.So,the third-party logistics industry emerged.Compared to traditional logistics,it is more specialized and targeted,with lower operating costs and improved efficiency,while also in line with the development trend of modern logistics industry.However,there are also many problems with third-party logistics,mainly due to lack of legal supervision,and there is also very little research in this area.Therefore,it is urgent to establish a regulatory legal system for third-party logistics.This article first introduces the concept and characteristics of third-party logistics in China,then analyzes the problems in the supervision of third-party logistics,and finally proposes several relatively reasonable governance paths.
