利益平衡机制下我国地理标志保护模式的反思与重构

摘　　要：【目的】立足于利益平衡机制,实现地理标志保护体系中不同利益格局和体系下多元主体间的均衡。【方法】对相关法条进行规范分析,深入探讨不同利益主体之间权力的竞合与冲突产生原因,剖析利益平衡机制在地理标志保护中的适用规则。【结果】在地理标志利益关系中,地理标志合法使用人利益和公共利益、地名商标权人和地理标志合法使用人、地理标志合法使用人与特定区域外市场竞争者之间存在着利益冲突。【结论】我国须重构地理标志保护模式,从立法层面将地理标志从证明商标、集体商标中分离,给予3种标志同级保护,将地理标志保护地域范围明确为自然区域并构建以地理标志专门法为主、商标法为辅的地理标志保护体系。[Purposes]Based on the mechanism of interest balance,this paper aims to achieve the balance among multiple subjects under different interest patterns and systems in the geographical indication protection system.[Methods]This paper analyzes the relevant laws and regulations,explores the causes of power concurrence and conflict among different interest subjects,and analyzes the applicable rules of the interest balance mechanism in the protection of geographical indications.[Findings]In the interest relationship of geographical indications,there are conflicts of interest between the interests of legitimate users of geographical indications and the public interests,the right of geographical name trademark and the legitimate users of geographical indications,and the legitimate users of geographical indications and the competitors in the market outside a specific region.[Conclusions]China needs to reconstruct the protection mode of geographical indications,separate geographical indications from certification marks and collective marks from the legislative level,give three types of geographical indications protection at the same level,define the geographical scope of geographical indications protection as natural areas,and build a geographical indications protection system with special geographical indications law as the main and trademark law as the auxiliary.
