摘　　要：目的:研究涉及手术机器人医疗损害纠纷案件的基本特征及责任承担情况,为未来手术机器人侵权纠纷案件的责任厘清提供参考。方法:纳入2015年1月至2023年9月中国裁判文书网中涉及手术机器人医疗损害纠纷案件63例,对案件的年份、科室分布、鉴定种类和情况、鉴定人出庭质证情况、责任比例、赔偿金额等进行分析。结果:2019年和2021年案例最多(20.6%);发生纠纷较多的科室为泌尿科(39.6%)、胃肠科(23.8%)及妇产科(11.1%);主要鉴定方式为医疗过失司法鉴定(76.1%);鉴定人出庭质证仅占20.6%;鉴定责任为次要责任最多(39.7%),判决责任比例31%~50%最多(30.2%);责任类型集中在医疗损害责任;赔偿金额集中10万~50万元(60.3%)。结论:对手术机器人临床应用扩大,产生纠纷的可能性提高,应当正确适用产品责任和医疗损害责任,加强针对性技术鉴定,为医患双方提供合理保障。Objective:To study the basic characteristics and liability of cases involving medical damage disputes related to surgical robots,providing a reference for clarifying responsibilities in future tort disputes involving surgical robots.Methods:This study included 63 cases of medical damage disputes involving surgical robots from the China Judgments Online between January 2015 and September 2023.The cases were analyzed based on the year,department distribution,types and situations of assessments,appearance of appraisers in court for cross-examination,liability proportion,and compensation amount.Results:The highest number of cases occurred in 2019 and 2021(20.6%);departments with more disputes were urology(39.6%),gastroenterology(23.8%),and obstetrics and gynecology(11.1%);the main type of assessment was medical negligence judicial appraisal(76.1%);appraisers appeared in court for cross-examination in only 20.6% of cases;secondary liability was the most common(39.7%),with the judgment responsibility ratio most frequently between 31% and 50%(30.2%);liability types were concentrated on medical damage;compensation amounts were mainly between 100,000 and 500,000 yuan(60.3%).Conclusion:With the expansion of clinical application of surgical robots,the possibility of disputes increases.It is necessary to correctly apply product liability and medical damage liability,strengthen targeted technical appraisals,and provide reasonable protection for both doctors and patients.
