数字经济背景下社区团购掠夺性定价的法律思考

摘　　要：由于数字平台所呈现的网络效应、双边/多边等特征,传统的掠夺性定价判定方法在这一领域的应用需要重新进行探讨,同时范畴尚不明确使得掠夺性定价的判断缺乏合理依据。为此在解决社区团购中掠夺性定价行为时采取合理分析原则,明确认定社区团购中掠夺性定价的范畴以及重视社区团购中掠夺性定价多元治理路径优化,将社区团购中掠夺性定价行为纳入反垄断法规制。Due to the network effect and bilateral/multilateral characteristics of digital platforms,the application of traditional predatory pricing judgment methods in this field needs to be re-explored,and the scope is not clear,which makes the judgment of predatory pricing lack a reasonable basis.Therefore,the principle of reasonable analysis is adopted when solving the predatory pricing behavior in community group buying,the scope of predatory pricing in community group buying is clearly determined,and the op⁃timization of multiple governance paths of predatory pricing in community group buying is emphasized,and the predatory pricing behavior in community group buying is included in the anti-monopoly legal sys⁃tem.
