摘　　要：更高质量就业政策目标的提出实际上是要求拉近实然就业质量与应然就业质量之间的差异,是对我国就业质量法律保障制度,特别是就业保护立法的检讨。只有把握就业质量及其评价体系的完整内容和核心要素,才能凸显就业保护立法对实现高质量就业的意义。我国理论和实务界一直盛行“就业保护过度说”,主要依据的是一些国外就业保护立法严格度评价指标体系的评价结论,未能综合考虑各种影响我国就业保护立法严格度的变量。研究这些影响变量可正确定位我国的就业保护水平,从而构筑以就业保护立法为核心的高质量就业法律保障体系,具体包括明确劳动者享有免于失业的权利、拓展就业保护规则的渊源、鼓励研究完整的就业质量评价标准、将解雇保护制度与固定期限劳动合同解绑、回归固定期限劳动合同的私法诚信等内容。The proposal of higher quality employment policy goals is actually aimed at narrowing the gap between the actual employment quality and the expected employment quality,and is a review of China's legal protection system for employment quality,especially employment protection legislation.Only by grasping the complete content and core elements of employment quality and its evaluation system can we highlight the significance of employment protection legislation in achieving high-quality employment.In Chinese theory and practice,the opinion of excessive employment protection has always been prevalent,mainly based on the evaluation conclusions of some foreign employment protection legislation strictness evaluation indicator systems,without comprehensively considering various variables that affect the strictness of China's employment protection legislation.Studying these influencing variables can accurately locate the level of employment protection in China,thus constructing a high-quality employment legal protection system with employment protection legislation as the core.This includes clarifying the right of workers to be exempt from unemployment,expanding the sources of employment protection rules,encouraging research on complete employment quality evaluation standards,unbinding the termination protection system from fixed term labor contracts,returning to the content of private law integrity in fixed term labor contracts and so on.
