摘　　要：当犯罪事实不能确定时,对嫌疑人从轻处罚。“罪疑惟轻”是古人在总结已有经验基础上提炼出的经典概念。统治者宣扬该观念不仅在于标榜宽仁之政,也在于通过从轻处罚教化百姓。该思想体现了古代仁政与慎刑思想,对现代中国司法实践亦有影响。If there is uncertainty surrounding criminal facts,the suspect shall be punished lightly.This classical concept was refined by ancient Chinese people on the basis of experience.It was promoted by rulers not only to demonstrate benevolent government,but also to educate the people through lighter punishments.Manifesting the ancient idea of benevolent government and prudential punishment,it also influenced modern Chinese judicial practices.
