摘 要:目前我国许多劳动法学者所主张的服务期协议应当适用惩罚性违约金,实际只是对惩罚性违约金的语义存在误解。用人单位在服务期协议正常履行下所应当获得的预期收益远高于用人单位的先行给付,系一种“损害赔偿额的预定”,属于民法语境下的赔偿性违约金的范畴。我国《劳动合同法》将服务期违约金的法定上限限制在用人单位先履行义务的范围内而不保护其合同的期待利益,不利于劳资之间交换正义的实现。At present,many labor law scholars in China advocate that the service period agreement should be applied to punitive breach of contract,but there is actually a misunderstanding of the meaning of punitive breach of contract.It can be seen that the expected income of the employer under the normal performance of the service period agreement is much higher than the advance payment of the employer,it is a kind of"damages predetermined",which belongs to the category of compensatory liquidated damages in the context of civil law.China's labor law limits the legal upper limit of the penalty for breach of contract during the service period to the scope of the employer to fulfill the obligations without protecting the expected benefits of the contract,which is not conducive to the realization of the exchange of justice between labor and capital.
