摘　　要：中华法系在数千年发展历程中,吸纳了来自不同朝代、不同民族、不同类型的众多制度文化资源,形成了兼收并蓄的开放胸怀,至唐代终于发展为蔚为大观的中华法系,并为后世和周边国家所承继,留下众多极富多元性和包容性、内涵丰富而饱含活力的制度文化遗产。中华法系以儒家仁道精神为价值内核,包含了诸多具有民本主义精神的制度原则;以“天理”为代表的制度正义原则,闪耀着良善法制文化的理性主义光辉;注重和合价值并以之为以法治国的重要思想指引,有助于建构和谐持久的法律秩序;尊重自然规律、重视环境保护的理念和绿色原则,具有超越时空的魅力。深具包容性的中华法系,对于当今的法治建设和生态文明建设而言,是一笔巨大且宝贵的精神财富。In the course of its development for thousands of years,the Chinese legal family absorbed many institutional and cultural resources from different dynasties,different nationalities and different types,forming an inclusive and open-minded characteristic.In the Tang Dynasty,the Chinese legal family finally developed into a grand system,and was inherited by later genera-tions and neighboring countries,leaving behind many institutional and cultural heritages that are highly diverse,inclusive,rich in connotation and full of vitality.The Chinese legal family takes the Confucian spirit of benevolence and Dao as its core value,and contains many institutional principles with the spirit of people-oriented;the principle of system justice represented by natu-ral principles shines with the rationalist glory of good legal system culture;paying attention to the value of harmony and taking it as an important ideological guideline of governing the country by law which is helpful to build a harmonious and orderly legal order;the concept of respecting the laws of nature and attaching importance to environmental protection and the green principle,which have a charm that transcends time and space.The deeply inclusive Chinese legal family is a huge and valuable spiritual wealth for the construction of the rule of law and the construction of ecological civilization.
