摘 要:数据可携制度是数据规则体系的重要组成部分,对畅通数据资源大循环、支撑建设数字中国具有重要意义。数据可携可以增强用户对其数据的控制,促进数据流通和价值释放,并推动数字市场实现公平竞争和数字经济普惠式增长,但是也可能带来数据多元主体利益冲突和数据安全风险挑战,并可能阻碍数字技术应用创新。当前数据可携制度构建仍然面临多方利益难协调、可携数据边界不清晰、数据可携模式存争议、数据格式标准化和互操作实现困难等难点问题,具体实践还在不断尝试探索之中。中国应结合国情循序渐进推进数据可携制度的构建和实践落地,重视数据互操作理念及其相关技术系统的研发支持,并鼓励企业提前布局数据可携实验项目。Data portability is an important component of the data rule system,which is of great significance for smooth circulation of data resources and supporting the construction of a digital China.Data portability can enhance users'control and rights over their data resources,promote the circulation and value release of data resources,and promote fair competition and inclusive growth of the digital economy in the digital market.However,it may also bring about interest conflicts for multiple entities of data resources and data security risks,as well as may hinder innovation in digital technology and applications.The current construction of data portability system still faces difficulties in balancing the interests of data stakeholders at different levels,unclear boundaries of the scope of portable data,disputes over the mode and path of data portability,difficulties in standardization data formats and data interoperability,as well as challenges in security risks.And practical solutions for data portability are also constantly being attempted and explored.China should gradually and steadily promote the construction and implementation of data portability based on its national conditions.China should attach special importance to the research and development support of data interoperability concepts and related technical systems,and encourage enterprises to layout and carry out data portability experimental projects in advance.
