摘　　要：通过梳理1973年以来我国环境政策的历史经验和环境法律的制定规律,发现在缺乏环境法律或者环境法律滞后于社会发展需要、又迫切需要进行政策改革时,环境政策可以为环境法律的制定提供相应的指引和依据,初步判断环境政策和环境法律的关系是一个螺旋式上升的演变过程。在近50年的实践与探索过程中,环境政策与环境法律的交织与耦合出现了交融度不够、耦合界限模糊等问题。为破解这一耦合难题,更好发挥两者的优势,需要准确界定环境政策与环境法律各自的功能与定位,把握协调化和整合化两项关键,塑造合适的耦合点、耦合度、耦合方式,进而促进环境政策与环境法律的互联互动、合理转化。By combing the historical experience of China s environmental policy and the law of environmental law enactment since 1973,it is found that environmental policy can provide the corresponding guidance and basis for the enactment of environmental law in the absence of environmental law or when environmental law lags behind social development needs and policy reform is urgently needed.Therefore,the relationship between environmental policy and environmental law is a spiraling evolution process.In the course of nearly 50 years of practice and exploration,such problems as insufficient blending degree and fuzzy coupling boundary can still be found in the interweaving and coupling of environmental policy and environmental law.In order to solve this coupling problem and give better play to the advantages of the two,it is necessary to accurately define the functions and positioning of environmental policies and environmental laws,grasp the two keys of coordination and integration,and shape the appropriate coupling point,coupling degree and coupling mode,thus promoting the interconnection and rational transformation of environmental policies and environmental laws.
