行政处罚权下放乡镇街道制度困境与优化策略--基于J省的实践

摘　　要：行政处罚具有多重面向特质,作为国家治理工具的重要组成部分,事关国家治理体系和治理能力的现代化。《行政处罚法》第24条第1款规定行政处罚权下放乡镇人民政府/街道办事处行使制度,论文从行政主体维度阐释其理论逻辑,立足法律规范检视省实践,发现下放决定主体不具体、承接条件不明晰、下放权力标准不明确、下放程序不健全、法制审核能力不匹配等五个困境。研究认为,应当着重从明确省级政府为下放决定主体、细化乡镇街道承接条件、厘清下放权力标准、完善权力下放程序、强化法制审核能力建设等五个方面进行优化,以期实现制度效能最大化。Administrative penalties have multiple characteristics,and as an important component of national governance tools,they are related to the modernization of the national governance system and governance capacity.Article 24,Paragraph 1 of the Administrative Penalty Law stipulates the system of delegating administrative penalty power to Townships People's(Sub-district oflice)Government.This paper elabrates its theoretical logic from the perspective of administrative subjects,and examines the practice of J Province based on legal norms.five dilemmas were found:the decision-making body for delegation is not specific,the conditions for acceptance are not clear,the standards for delegation of power are not clear,the delegation process is not sound,and the legal review ability is not matched.Research suggests that optimization should focus on five aspects:clarifying provincial governments as the decision-making body for delegation,refining the conditions for township People's(Sub-district oflice)Government acceptance,clarifying the standards for delegation of power,improving the procedures for delegation of power,and strengthening the construction of legal review capabilities,in order to achieve maximum institutional efficiency.
