摘 要:物权是制约城市更新实施的关键要素,也是更新收益分配的基本依据。面对多元的权利主体和复杂的权属关系,权利变换是利益协调的途径之一,合约是关于权利变换的承诺。从物权视角出发,以南京小西湖更新为例,总结其在现状物权约束下的更新方式,根据权利变换的程度将其分为原址自住、部分出租、整体出租三类,分别具有不同的权利关系和合约安排。物权视角下的利益协调机制以权利变换为手段,以合意驱动的合约选择为途径,构建更新后的利益结构。各权利人之间以合约为纽带,出于各自的利益需求和目标,促进或约束彼此的使用行为。通过总结不同更新方式下的利益关系、合约类型和作用方式,以期为有机更新、自主更新提供借鉴。Property right is the key factor restricting the implementation of urban regeneration,and also the basic basis for the distribution of regeneration interest.Right transformation is one of the ways to coordinate interests,and contract is a commitment to right transformation.From the perspective of property rights,this paper takes the regeneration of the Xiaoxihu as an example to summarize its methods and paths,which can be divided into three ways,self occupancy,partial rent and overall rent,with different right relationships and contractual arrangements.The interest coordination mechanism from the perspective of real right takes the right transformation as a means and the agreement driven contract choice as a way.And contracts promote or restrict obligee's behavior for their own benefit needs and goals.
