“红头文件”对造价的影响和处置——以武汉市渣土车整治为例

摘　　要：《标准施工招标文件》《建设工程施工合同(示范文本)》均规定在基准日期后法律变化导致承包人在合同履行过程中所需要的费用发生除市场价格波动引起的调整约定以外的增加时,由发包人承担由此增加的费用。其术语定义中法律的解释为法律、行政法规、部门规章,以及工程所在地的地方法规、自治条例、单行条例和地方政府规章,未包含行政规范性文件。结合武汉市渣土车整治“红头文件”出台和地方性政府配套指导价滞后这一实际问题,提出行政规范性文件对工程造价所造成影响的处理原则和对《标准施工招标文件》及《建设工程施工合同(示范文本)》的修改建议。Standard Construction Bidding Document and Construction Project Construction Contract(Model Text)both stipulate that when there is a legal change after the benchmark date that leads to an expenses increase in the contract performance process required by the contractor,except for the adjustment agreement caused by market price fluctuations.The interpretation of laws in its terminology definition includes laws,administrative regulations,departmental rules,as well as local regulations,autonomous regulations,separate regulations,local government rules in the location of the project,and does not include administrative normative documents.Based on the issue of the introduction of the′Red-Headed Document′for the rectification of slag trucks in Wuhan and the lagging guidance prices of local governments,this paper proposes principles for handling the impact of administrative normative documents on project costs and suggestions for modifying the Standard Construction Bidding Document and Construction Project Construction Contract(Model Text).
