论西塞罗的法律修辞学——以《为诗人阿尔基亚辩护》为文本的分析

摘　　要：修辞学被认为是言说的艺术,这种言说技艺是通过言辞中的理性和情感双重因素的共同作用展开的。西塞罗是在亚里士多德理论的基础上构建了其修辞学理论,西塞罗的法律修辞学可以从理性说服和情感说服两方面来进行分析。利用论题学中的类比、对反、省略三段论等逻辑论证的方式来展开理性说服。情感说服通过展现辩护人自身及当事人的优秀道德品质,利用怜悯激发听众对当事人的同情,利用罗马公民的爱国热情调动民族精神来达到说服的目的。以其演说词《为诗人阿尔基亚辩护》为文本展开对理性说服和情感说服在实践中的运用,西塞罗的法律修辞学影响了罗马法的政治性因素,促进了罗马法的技术性因素的发展,是罗马法律科学走向成熟的标志。Rhetoric is considered the art of speech,and the development of this speaking skill is achieved through the combined action of rational and emotional factors in speech.Cicero constructed his rhetorical theory based on Aristotle's theory.It is reasonable to grasp Cicero's legal rhetoric from both rational persuasion and emotional persuasion.Using logical reasoning methods such as antithesis,analogy,and enthymeme of topics in argumentation to carry out rational persuasion.Emotional persuasion achieves the goal of persuasion by showcasing the excellent moral qualities of the defense counsel and the parties involved,using compassion to inspire sympathy from the audience towards the parties involved,and using the patriotic enthusiasm of Roman citizens to mobilize national spirit.Using his speech"For Archias"as the text to explore the application of rational persuasion and emotional persuasion in practice,Cicero's legal rhetoric influenced the development of political factors in Roman law,promoted the development of technical factors in Roman law and marked the maturity of Roman legal science.
