摘　　要：中国对外关系法体系,应当是以《中华人民共和国对外关系法》(下文简称《对外关系法》)为基础的、完备的、有机联系的法律法规体系。中国对外关系法体系的构建,是指以《对外关系法》为基础,构建由中国对外关系领域调整各类对外关系的法律法规组成的有机法律体系。这一独特的法律体系,必须是完备的、内部协调统一的、具有中国特色的、能够推进和保障涉外法治建设要求、促进和保障中国对外交往的法律体系。为此,有必要全面梳理中国对外交往领域的法律规范,认识对外关系法体系之现状,框定中国对外关系法体系的范围,厘清不同主体和法律之间的关系,明确《对外关系法》与其他法律规范的衔接关系,以及对外关系法体系的内部关系,并发挥《对外关系法》的统筹作用。在该过程中,坚持中国特色社会主义法治方向,以推动构建人类命运共同体为统领,坚持真正的多边主义,是中国对外关系法体系的目标理念和本质要求,也是中国对外关系法体系区别于美国和欧盟对外关系法体系的本质特征。尽管构建中国对外关系法体系是一项复杂而艰巨的系统工程,但我们应深刻认识其重大的现实意义和深远的历史意义。China's Foreign Relations Law System should be a complete and organically linked system of laws and regulations based on the Law on Foreign Relations of the People's Republic of China.The systemization refers to construction of an organic legal system consisting of laws and regulations on all types of legal relations in the field,based on the Law on Foreign Relations of the People's Republic of China.This unique legal system must be complete,internally coordinated and unified,with Chinese characteristics,and capable of promoting and safeguarding the requirements for the construction of the rule of law in foreign affairs,as well as promoting and safeguarding China's foreign relations.To this end,it is necessary to comprehensively sort out the legal norms in the field,to understand the current status and to define the scope of China's Foreign Relations Law System,to clarify the relationship between different subjects and laws,and to clarify the relationship between the Law on Foreign Relations of the People's Republic of China and other legal norms,as well as the internal relationship of the system,and to leverage its role of coordination.In this process,adhering to the direction of the rule of law of socialism with Chinese characteristics,taking the promotion of the construction of a human community with a shared future as the overarching principle,and adhering to true multilateralism are the core targets and essential requirements of China's Foreign Relations Law System,which are also the features of China's Foreign Relations Law System that differentiate it from those of the U.S.and the EU.Although the construction of China's Foreign Relations Law System is a complex and arduous systematic project,we should have a profound understanding of its practical and far-reaching historical significance.
