摘　　要：国际投资规则走到了发展的十字路口。无论是多边改革,还是国别探索,国际投资规则改革实践呈现多样化特征,尚未形成主导性趋势。地缘竞争逐步渗透到国际投资立法和司法过程。国际投资规则的旧矛盾进一步变化,缔约国加大对跨国投资的引导、强调负责任投资:国际投资规则区域化加速,还面临经济制裁与驱逐投资等新情境。国际投资规则发展过程中出现均衡自由主义与地缘法制主义的竞争,规则在多边主义与单边主义、去政治化与泛政治化、确定性与灵活性、集中化与去中心化等目标之间摇摆。未来一段时间内,国际投资规则的“投资+”趋势仍将延续,新兴规则会不断涌现,形式将更加多样化。其中,中国在相关国际协定中采取了渐进性、包容性、仲裁与对话相结合的模式,促进国际投资规则从裁判式向协商式转型,为新兴经济体与发达经济体的投资规则制定提供了一种新范式。The international investment rules have come to a crossroads.In terms of both multilateral reform and national exploration,the reforms of international investment rules have been diversified without a dominant vision.Meanwhile,geopolitical competition among major powers have gradually filtered into the process of international investment lawmaking and adjudication.The traditional debates on international investment rules have been further evolved with more guidances of contracting states on transnational investments and more emphases on responsible investments;the regionalization of international investment rules has been accelerated and new contexts for economic sanction and investment expulsion have been sparked off.The future development of international investment rules will see the emergence of competition between balanced liberalism and geo-legalism,and rules swing between multilateralism and unilateralism,between depoliticization and overpoliticization,between certainty and flexibility,and between centralization and decentralization.In the foreseeable future,the trend of"investment plus"of international investment rules will continue and new rules will continually emerge with diversified forms.In relevant international agreements,China adopts a gradual and inclusive model combining dialogue and arbitration,representing the shift of international investment rules from an adjudicative mode to a consultative mode that offers a new paradigm of investment rules for both emerging and developed economies.
