摘　　要：党的二十大报告指出,要加强重点领域、新兴领域、涉外领域立法,统筹推进国内法治和涉外法治,以良法促进发展、保障善治。深入分析农产品营商环境法治化的意义和目标导向发现,目前农产品营商环境法治化面临绿色壁垒和技术壁垒、诉讼机制和非诉机制选择等贸易壁垒和政策差异。我国应在“互信合作”原则下打破农产品贸易壁垒,积极参与规则谈判,争取制度优势,重视贸易救济效果,实现政策间协调。同时,健全农产品跨境贸易法治体系,探索纠纷解决新机制,强化农产品听证制度实施与知识产权领域保护,打造专业化涉外法治人才队伍。The report of the twentieth CPC National Congress emphasized that legislation should be strengthened in key,emerging and foreign-related areas.It also highlighted the importance of promoting the rule of law both nationally and internationally to ensure good governance and promote development through effective laws.Through an in-depth analysis of the profound connotation and goal orientation of the rule of law in the business environment for agricultural products,it is revealed that the rule of law in the business environment for agricultural products is currently faced with the real obstacles of trade barriers and policy differences,such as green barriers and technical barriers,and the choice of litigation mechanisms and nonlitigation mechanisms.China should break down barriers to agricultural trade under the principle of"mutual trust and cooperation",actively participate in the negotiation of rules,strive for institutional advantages,pay attention to the effectiveness of trade remedies,and achieve inter-policy coordination.At the same time,it needs a need to improve the rule of law system for cross-border trade in agricultural products,explore new mechanisms for dispute resolution,strengthen the implementation of the hearing system for agricultural products and the protection of intellectual property rights,and build a specialized team of foreign-related personnel.
