虚拟财产视野下平台权力的规范路径——基于20份平台服务协议的实证研究

摘　　要：研究范式转变下的虚拟财产保护需以用户和平台之间的利益平衡为着眼点,平台权力实则是处理该问题首先面对的难关。实证研究表明,平台凭借其准立法权,编制了一套逃避自身责任、抹杀用户权利、充满虚伪言辞,最终将用户虚拟财产利益置于危困动荡之境的规则体系——服务协议。以调整服务协议来规制平台权力,实则是保护用户虚拟财产利益的一条极具针对性、效率性,又能兼顾平台权力生成逻辑的最佳路径。具体需在微调原则的基础上通过信息原则确立平台方的双重提示义务;通过内容控制原则确立起消费者源地管辖机制、基于客观合约性标准的平台瑕疵责任制度、平台惩罚的正当性和合比例性要求、合同解除权及虚拟财产利益返还制度,并适度排除用户对虚拟财产的使用限制。The protection of virtual property under the research paradigm shift needs to focus on balancing the interests of users and platforms,and the platform power is the primary difficulty in dealing with this issue.Empirical studies have shown that platforms,relying on their quasi-legislative power,have compiled a set of rules and regulations—service agreements—that evade their own responsibilities,erase the rights of users,are full of hypocritical rhetoric,and ultimately place the interests of users′virtual property in a precarious and turbulent situation.Adjusting the service agreement to regulate the power of the platform is in fact the best path to protect the interests of users'virtual property with great relevance and efficiency,while taking into account the logic of generating the power of the platform.Specifically,it is necessary to establish the dual reminder obligation of the platform through the information principle;through the content control principle,it is necessary to establish a mechanism of jurisdiction at the place of origin for consumers,a liability system for platform defects based on objective conformity criteria,the principle of justification and proportionality of platform pen⁃alties,a system of contractual rescission rights and return of virtual property benefits,and moderate exclusion of limitations on the use of virtual property by users.
