我国档案行政处罚裁量基准制定问题研究

摘　　要：为确保档案行政处罚的公正性和合理性,各地档案主管部门制定了档案行政处罚裁量基准并将其应用于执法实践中。文章通过对档案行政处罚裁量基准制定情况的分析,发现其存在裁量基准内容结构不合理、制定程序不规范、动态调整不及时等问题。国务院办公厅出台的《关于进一步规范行政裁量权基准制定和管理工作的意见》对行政裁量权基准制定的权限、内容、程序等方面提出了明确的规范要求,基于此提出要完善内容架构、规范基准制定程序以及动态调整等建议,以期助力提高档案主管部门行政执法和制度建设水平。To ensure the fairness and rationality of archival administrative penalties,regional archival authorities have established archival administrative penalty discretion benchmarks and implemented them in law enforcement practices.The thesis reveals prevalent issues in these benchmarks,including structural inconsistencies,formulation procedure irregularities,and insufficient timely adjustments.The General Office of the State Council of the People's Republic of China issued"Opinions on Further Standardizing the Formulation and Management of Administrative Discretion Benchmark",outlining explicit normative requirements for authorities,content,and procedures in establishing these benchmarks.Suggestions are proposed to enhance the structural framework,standardize benchmark formulation procedures,and dynamic adjustments.These recommendations aim to enhance both archival authorities'administrative law enforcement and institutional development.
