摘　　要：因“一带一路”共建国家在经济、法律及文化等诸多方面存在差异,“一带一路”建设中产生的外国投资者与东道国间的投资争端显得尤为复杂。调解作为一种替代性争端解决方式,具有其他争端解决方式无可比拟的优势。在“一带一路”建设中推广调解机制具有可行性,但同时也面临一定的现实困境。文章在借鉴其他国际调解制度的基础上,结合“一带一路”建设的特殊性,从常设机构的设置、调解介入时间、调解员的资格及选任、调解的时限、调解保密及例外规定、调解的执行等方面构建了具有可操作性、可执行性的投资争端调解机制,以期保障“一带一路”建设的行稳致远,同时助力推动国际投资争端解决的多元化发展。Due to the differences between countries in the Belt and Road cooperation network in many aspects such as economy,law and culture,the investment disputes between foreign investors and host countries are particularly complicated.As an alternative dispute resolution method,mediation has incomparable advantages over other dispute resolution methods.The promotion of mediation in the construction of the Belt and Road Initiative has both feasibility and realistic difficulties.On the basis of learning from other international mediation systems and combining with the special conditions of the Belt and Road Initiative,this paper constructs an operable and enforceable investment dispute mediation mechanism from the aspects of the establishment of permanent institutions,mediation intervention time,mediator qualification and appointment,mediation time limit,mediation confidentiality and exception provisions,and mediation implementation,so as to ensure the stability and long-term development of the Belt and Road construction,while helping to promote the diversified development of international investment dispute settlement.
