摘　　要：对流动人口管理的行政法治问题进行深入研究与探讨,有助于推动流动人口服务与管理机制改革,有利于夯实基层社会治理根基和提升基层治理能力。廓清“人口流动”“流动人口”与“行政法治”等概念利于梳理流动人口管理行政法治的理论基础。首先,学者们对流动人口相关概念的界定标准并不统一,以致出现了对流动人口规模理解和认识的偏差。其次,学者们一般将行政法治看作是行政法的一项重要原则,揭示了行政法的根本价值属性和基本价值目标。行政法治的内涵,可以从理念、法律制度和法治实践三个层面理解。最后,研究流动人口管理的行政法治,需要探求其理论依据,即“服务行政”理念、比例原则和正当法律程序。这些是服务与管理流动人口的正当性基础和重要理论基础。In-depth research and discussion on the administrative rule of law in the floating population management is not only conducive to promoting the reform of the service and management mechanism of floating population,but also beneficial to consolidating the foundation of social governance and improving the capacity of governance at the grassroots level.On the basis of clarifying the concepts of“population flow”“floating population”and“administrative rule of law”,it is urgent to sort out the theoretical basement of administrative rule of law in the floating population management.First of all,scholars do not have a uniform definition of the concepts related to the floating population,resulting in a deviation in understanding and cognition of the size of the floating population.Secondly,scholars generally regard administrative rule of law as an important principle,which reveals the fundamental value attribute and basic value target of administrative law.The connotation of administrative rule of law can be understood from three levels:idea,legal system and legal practice.Thirdly,in order to study the administrative rule of law of floating population management,it is necessary to explore its theoretical basis,that is,the concept of“serving administration”,the principle of proportion and due legal procedures.These are the legitimate basis and important theoretical basis of service and management of floating population.
