新颖性宽限期的理解与适用

摘　　要：【目的】针对《专利法》第二十四条第(四)项规定的“他人未经申请人同意而泄露其内容的”可要求新颖性宽限期的情形,《专利审查指南》仅给出了宽泛的规定,在申请人提交材料和专利审查时均存在一定的疑惑,有必要对该问题进行详细探讨。【方法】结合实际案例,对“他人”的理解、“未经申请人同意”的判断、不同泄露形式所产生的影响、宽限期声明提出的时机和形式等问题进行详述和探讨。【结果】在专利审查过程中,对《专利法》第二十四条第(四)种情形进行判断时,要核实提出新颖性宽限期声明的时机,还要准确判断证据是否属于“他人未经申请人同意而泄露”;在发明创造过程中,要采取必要的保密措施等降低发明创造被意外公开的风险;在专利申请过程中,要在规定的时间内及时按照要求提供宽限期的声明和具备说服力的证明材料。【结论】对《专利法》第二十四条第(四)项规定的“他人未经申请人同意而泄露其内容的”可要求新颖性宽限期的情形有了清晰的认识,以期提高专利审查的质量和效率,保障申请人的合法权益。[Purposes]In terms of Article 24 of the"Patent Law"stipulating that"others who disclose their contents without the consent of the applicant"may require a grace period for novelty,the"Patent Examination Guidelines"only gives a broad provision,resulting in certain doubts when the applicant submits the material and the patent examination,and it is necessary to discuss the issue in detail.[Methods]Based on an actual case,this paper elaborated and discussed understanding of"others",judgment of"without the consent of the applicant",impact of different disclosure forms,timing and form of grace period statements.[Findings]In the process of patent examination,when judging the situation of"disclosed by any person without the consent of the applicant"as specified in the Article 24 of the Patent Law,it is necessary to verify the timing of proposing a novelty grace period statement,and to accurately judge whether the evidence belong to"disclosed by any person without the consent of the applicant".In the process of invention creation,necessary confidentiality measures should be taken to reduce the risk of accidental disclosure of the invention.In the process of patent application,it is necessary to provide the grace period statements and convincing proof materials in time according to the requirements within the specified time.[Conclusions]Through the above analysis,we have a clear understanding of the situation that"disclosed by any person without the consent of the applicant"as specified in the Article 24 of the Patent Law in which grace period of novelty may be required,in order to improve the quality and efficiency of patent examination and protect the legitimate rights of the applicant.
