摘　　要：传统村落蕴含着丰富的历史信息与文化景观,对于传承民族文化、助力乡村振兴有着重要意义。传统村落保护检察公益诉讼是监察体制改革后检察机关职能的创新,发挥了生态文明战略检察监督的兜底作用,体现了民法典时代检察公益诉讼的价值引导。当前,检察机关参与传统村落保护还存在法律法规不足、公益诉讼介入滞后、较难平衡保护与发展的困境。应进一步完善传统村落保护法律法规体系,优化检察公益诉讼诉前程序,推动检察公益诉讼融入社会治理。Traditional villages contain abundant historical information and cultural landscape,which are of great significance for inheriting national culture and helping rural revitalization.The traditional village protection procuratorial public interest litigation is the innovation of the function of the procuratorial organ after the reform of the supervision system,which plays the role of the ecological civilization strategic procuratorial supervision and embodies the value guidance of the procuratorial public interest litigation in the era of the Civil Code.At present,the procuratorial organ’s participation in the traditional village protection still has problems with the relatively insufficient legislative supply,the lagging intervention of the public interest litigation,and the difficulty of balancing the interests of all parties.We should further improve the legal system of the traditional village protection,optimize the pre-litigation procedure of procuratorial public interest litigation,and promote the integration of procuratorial public interest litigation into social governance.
