摘　　要：体育赛事产业的收益重心近年来逐渐向赛事转播相关权益倾斜,然而法学理论和司法实践对体育赛事转播相关权益的理解仍存分歧,混用严重,导致我国在体育赛事转播相关权益的保护方面犹显不足。体育赛事转播权是赛事组织者最重要的权益之一,其实现过程也就是体育赛事的录制本身是赛事的主要支出,而体育赛事转播画面作为赛事转播权实现的成果则是赛事组织者的重要财产和收益来源。从赛事组织者的角度对赛事转播相关权益进行统筹论证,着重参考“场所权+著作权”的保护模式分析体育赛事转播权的权利属性和架构,强调体育赛事转播权与赛事转播画面的区别和联系,同时探讨我国新《体育法》的发展和适用,试图为我国赛事转播产业发展提供稳定良性的助益。In recent years,the major income of the sports industry has been increasingly inclined to come from the sports broadcasting rights.However,there are differences in the understanding of the rights and interests related to sports broadcasting rights in both legal theory and judicial practice,which leads to insufficient protection of the rights and interests of sports broadcasting.The sports broadcasting right is one of the most important rights and interests of the sports organizers.The realization process,in other words,the recording of the sport events is the major expenditure,and the sports broadcasting pictures,as the result of the realization of the sports broadcasting rights,are the main property and income sources of the sports organizers.This article conducts a comprehensive argumentation of the rights and interests related to sports broadcasting from the perspective of organizers,focusing on the analysis of the right attributes and structure of sports broadcasting rights by referring to hause right(hausrecht)+copyright protection mode.It emphasizes the differences and connection between sports broaadcasting rights and broadcasting images,and explores the development direction and application of China's new<Sports Law>,hoping to provide stable and beneficial assistance for the development of China's sports broadcasting industry.
