旅客权益保护视角下航空旅客不循规行为的判定

摘　　要：由于界定抽象缺乏操作性,航空旅客循规与否的界限不清,存在机长错误判定而采取过重处置措施的情形,航空旅客权益面临受害风险。不循规行为违背了符合公序良俗的行为守则,且对航空秩序的侵害须达到严重程度或威胁航空安全。在实行行为的场合,要判断实行行为与严重侵害航空秩序事件或航空安全事故间法律上的因果关系成立;在言行表现的场合,既要判断言行表现与可能实施严重侵害航空秩序或威胁航空安全的行为间法律上的因果关系成立,也要判断可能实施的危害行为与严重侵害航空秩序事件或航空安全事故间法律上的因果关系成立。There is ambiguity in distinguishing whether air passengers are following regulations or not due to the lack of clear operational definitions.The passenger's rights and interests are at risk when the pilot makes a wrong judgment and takes excessive measures.The unruly acts violate the code of conduct in accordance with public order and good morals,and the violation of aviation order must reach a serious degree or pose a threat to aviation safety.In cases involving the unruly acts,it is necessary to determine the causality between the act and the serious violation of aviation order or aviation safety accident.In cases of verbal or behavioral expressions,it is essential not only to establish the legal cau-sation between expressions and the potential for serious infringement on the aviation order or threats to aviation safety but also to establish the legal causality between the possible harmful acts and the serious violation of aviation order or aviation safety accidents.
