摘 要:从法制发展和社会需要来看,编纂环境法典对进一步完善生态环境法律体系发挥着关键作用。而生态环境纠纷解决作为环境法典生态环境责任章的重要内容,是对不同类型生态环境责任的承担及其制度设计作出的程序性回应。生态环境纠纷解决的法典化,首先就是要明晰生态环境纠纷解决与传统纠纷解决的关系,确立生态环境纠纷解决机制的逻辑框架;其次是分析环境法典中生态环境纠纷解决机制面临的实践性难题;最后是围绕法典化对生态环境纠纷解决机制遇困境提出规范化的设计方案。From the perspective of legal development and social needs,the compilation of environmental codes plays a crucial role in further improving the ecological and environmental legal system.The resolution of ecological and environmental disputes,as an important part of the chapter of ecological and environmental responsibility in environmental code,is a procedural response to the assumption of different types of ecological and environmental responsibilities and their institutional design.The codification of ecological environmental dispute resolution first requires clarifying the relationship between ecological environmental dispute resolution and traditional dispute resolution,and establishing a logical framework for the mechanism of ecological environmental dispute resolution;Secondly,the practical difficulties faced by the ecological environmental dispute resolution mechanism in environmental code should be analyzed;Finally,a standardized design plan should be proposed around the difficulties encountered in the resolution mechanism of ecological environmental disputes through codification.
