摘　　要：促进跨境供应链安全与效率是统筹安全和发展的重要内容,尤其是在世界从传统全球化向新全球化变迁的历史阶段,突发公共卫生事件在全球范围内的流行和中美贸易博奔的深入,对跨境供应链安全与效率提出严峻挑战,各国对跨境供应链安全与效率领域国际规范的需求日益提升。世界海关组织对安全与效率的协同推进,世界贸易组织效率优先、安全次之的价值选择及其多边制度措施,为世界各国在跨境供应链安全与效率领域提供了可选择和可创新的借鉴。我国虽建立了包括企业申报制度、风险管理制度和经营者认证制度在内的跨境供应链制度,但仍存在着诸如制度之间规定的碎片化、制度本身不完善和应对突发事件能力不足等问题,应在遵循安全发展理念、“端到端”监管、国际国内法则联动和可视化的基础上,构建与整合跨境供应链法律制度体系,进一步完善企业申报制度、风险管理制度和经营者认证制度,构建跨境供应链数据通道制度和弹性化制度,以更好地促进我国跨境供应链的安全与效率。Promoting cross-border supply chain security and efficiency is an important element of integrating security and development.In particular,the historical stage of the world's change from the old globalization to the new globalization,the global epidemic of public health emergencies and the deepening of the trade frictions between China and the U.S.have posed serious challenges to cross-border supply chain security and efficiency.Therefore,the demand for international regulations in the field of cross-border supply chain security and efficiency is increasing.The WCO's synergistic promotion of security and efficiency and the WTO's value choice of giving priority to efficiency and second priority to security,as well as its multilateral system and measures,provide optional and innovative references for countries around the world in the field of cross-border supply chain security and efficiency.Although China has established a cross-border supply chain system including enterprise declaration system,risk management system and certified operator system,there are still problems such as fragmentation of regulations between systems,imperfect system itself and inadequate ability to respond to emergencies,etc.Based on following the concept of safe development,"end-to-end"regulation,international and domestic laws linkage and visualization.Based on the concept of safe development,"end-to-end"regulation,international and domestic law linkage and visualization,China should build and integrate the legal system of cross-border supply chain,further improve the system of enterprise declaration,risk management system and certified operator system,and build the system of"data channel"and flexible system of cross-border supply chain,so as to better serve to promote the security and efficiency of cross-border supply chain in China.
