摘　　要：违纪构成体系是党纪处分制度的核心问题,也是追究违纪党员党纪责任的制度基础。借鉴犯罪构成的一般理论,违纪构成分别形成了“四要件”违纪构成论、“三阶层”违纪构成论和“两要素”违纪构成论三种学说和相应的违纪构成体系。其中“四要件”违纪构成论与“四要件”犯罪构成论一样,缺陷较为明显。与“四要件”违纪构成论相比,“三阶层”违纪构成论较为合理,但也存在诸多不足。相比较而言,植根于“三阶层”违纪构成论基础上的“两要素”违纪构成论更有利于坚持违纪客观性,使违纪概念保持独立性,便于更准确界定违纪行为;确保了客观判断优先和事实真实优先;明确区分违规阻却事由与责任阻却事由,有利于得出正确结论;使违纪认定更具便捷性。The constitution system of violation of discipline is the core issue of the Party's disciplinary punishment system,and also the institutional prerequisite for investigating the Party's disciplinary responsibility of Party members who violate discipline.Drawing on the general theory of criminal composition,the theory of constitution of violation of discipline consists of four requirements,three classes and two elements,thus forming three different systems of violation of discipline.Among them the theory of four requirements has obvious defects and has been criticized.As s new theory,the theory of three classes of discipline violation is more reasonable than the theory of four requirements of discipline violation,but there are also many shortcomings.Comparatively speaking,the theory of two elements of violation of discipline,which is rooted in the theory of three classes,is favorable to adhering to the objectivity of discipline violation,keeping the relativity of violation of discipline,facilitating more precise definition of disciplinary offense,ensuring the objective judgment of the priority and the objective truth,drawing the correct conclusion to clearly distinguish the violation and the liability,achieving convenient recognition of discipline violation.
