夫妻忠诚协议的法律性质与效力认定

摘　　要：夫妻忠诚义务是道德义务,更是现行婚姻家庭立法规定的法律义务。夫妻忠诚协议是身份协议,其本质是夫妻双方基于意思自治将法定忠诚义务具体化的约定。进入到效力认定环节,忠诚协议存在真实意思表示认定区隔、忠诚义务范围边界模糊、财产责任调整标准阙如的疑难问题。考察是否系当事人的真实意思表示应回到婚姻家庭的具体场景下进行考量,同时对于欺诈、胁迫行为的认定应提高其负面互动的容忍性。忠诚义务的范围应限定为内涵随社会发展而动态丰富的性忠诚。当过错方所需承担的财产责任过高时,法院基于利益平衡的现实考量,可结合夫妻双方的过错程度、对婚姻家庭的贡献程度、实际履行能力的具体因素,对过高的财产责任约定进行调整,使其恢复到理性区间。The loyalty obligation of husband and wife is the moral obligation,but also the legal obligation stipulated by the current marriage and family legislation.The husband and wife loyalty agreement is the identity agreement,whose essence is the husband and wife to specify the legal loyalty obligation based on the autonomy of will.In the link of effectiveness identification,the loyalty agreement has difficult problems such as the true expression of meaning identification,the fuzzy boundary of loyalty obligation,and the lack of property responsibility adjustment standard.The investigation of whether the true expression of the parties should be considered in the specific scenario of marriage and family,and at the same time,the identification of fraud and coercion should improve the tolerance of their negative interaction.The scope of loyalty obligation should be limited to the dynamically rich sexual loyalty with the development of society.When the property liability of the fault party is too high,the court can adjust the too high property liability agreement based on the specific factors of the fault degree of the couple,the contribution degree to the marriage and family,and the actual performance ability,so as to restore it to the rational range.
