摘 要:当前,我国金融消费者保护理论价值认识不足,逻辑体系欠缺。立法文件对金融消费者概念存在局限,未明确法律地位、定义,保护条款概括抽象,规范位阶较低。金融消费者保护专门立法推进缓慢,多依赖金融监管规定。各级法院对金融消费者保护价值认识程度参差不齐,有待从个案认可向普遍承认转变。我国应当吸收域外经验教训,从消费者、公平正义、行业经营、国家安全、国民经济发展五个层面系统认识金融消费者保护的价值内涵,具体来说就是:提振金融消费信心的基本前提,实现金融公平正义的必要方式,保障金融业稳健经营的关键因素,维护金融体系安全稳定的重要基础,发挥金融助推国民经济发展作用的制度保障。and of lower normative level.Progress in specialized legislation for financial consumer protection is slow,relying heavily on financial regulatory provisions.The level of understanding of the value of financial consumer protection varies among courts at all levels,and there is a need to shift from individual case recognition to universal recognition.China urgently needs to absorb the experience and lessons of foreign financial consumer protection,and systematically understand the value of financial consumer protection from five perspectives:consumers,fairness and justice,industry operations,national security and national economy,that is,boosting the basic premise of consumer confidence in financial consumption,achieving financial fairness and justice as a necessary means,ensuring the key factor of sound operation of the financial industry,maintaining the important foundation of the safety and stability of the financial system,and providing institutional safeguards to play a role in promoting the development of the national economy through finance.
