医疗美容纠纷的成因及解决路径研究——基于《民法典》生效后的100份民事判决书的分析

摘　　要：以《民法典》生效后的100份医疗美容纠纷民事判决书作为切入点,对医疗美容纠纷的成因及解决路径进行了研究。首先对这100份判决书中原告起诉原因进行分析整理后,将案件分为了人身损害型案件、退费型案件、效果型案件和告知型案件。然后对不同类型案件的判决内容从裁判依据、主体情况、案由情况等多角度进行了具体分析。随后根据分析结果并结合法律规定、文献资料等从医疗美容接受方、医疗美容行医方、政府监管方三方角度进行医疗美容纠纷的成因分析。最后针对分析出的成因提出了五点解决建议:一是为医疗美容接受方设定法定的审查义务;二是提高医疗美容接受方的法律意识;三是完善医疗美容专业人才系统的培养机制;四是完善我国医疗美容法律体系;五是加大监管力度,完善监管机制。The 100 civil judgments on medical cosmetology disputes after the entry into force of the Civil Code are used as an entry point to study the causes of medical cosmetology disputes and the path to their resolution.The 100 judgments were firstly analyzed and organized to classify the cases into personal injury cases,refund cases,effect cases and notification cases.The judgments of the different types of cases were then analysed from various angles,such as the basis of the decision,the subject matter and the cause of action.Based on the results of the analysis,the causes of medical cosmetology disputes are then analysed from the perspective of three parties:the recipient of medical cosmetology,the practitioner of medical cosmetology,and the government regulator,in conjunction with legal provisions and literature.Finally,five suggestions are put forward to address the causes of medical cosmetology disputes:firstly,to set a legal obligation for medical cosmetology recipients to review;secondly,to raise the legal awareness of medical cosmetology recipients;thirdly,to improve the training mechanism of medical cosmetology professionals;fourthly,to improve the legal system of medical cosmetology in China;and fifthly,to increase the supervision and improve the regulatory mechanism.
