从控制到免于打扰:数字时代隐私保护的范式转变

摘　　要：基于自主控制的积极隐私观奠定与发展了隐私保护的当代范式,但这一范式混淆颠倒了隐私的核心价值以及对其保护的恰当策略,由此陷入“越控制越侵犯”的逻辑怪圈。隐私所捍卫的核心价值在于人格尊严、自我建构与生活安宁而不是占有、控制与自决,其存在样态具有消极性、防御性、排他性与具身性。我们要转变隐私保护的范式,回归隐私保护的原初概念和人性基础,从“免于打扰”的消极隐私观出发,不求自主掌控而求消极防御,摒弃放任离身转向切己具身,划定清晰界限构筑物化保障,发展具身化、切己性和防御性的隐私保护技术、制度体系和道德能力,才能更好地保护隐私。The positive concept of privacy based on autonomous control is a contemporary paradigm for privacy protection,but this paradigm confuses and reverses the core values of privacy and appropriate strategies for its protection,and thus falls into the logical cycle of"the more control,the more infringement".The core values defended by privacy lie in personal dignity,self construction,and peaceful life,rather than possession,control,and self-determination.Its existence is negative,defensive,exclusive and embodied.We need to transform the paradigm of privacy protection,return to the original concept and human nature foundation of privacy protection,start from the passive privacy concept of"free from disturbance",seek passive defense instead of autonomous control,abandon laissez-faire disembodiment and shift towards personal embodiment,delineate clear boundaries and construct physical protection,develop embodied,personal and defensive privacy protection technologies,institutional systems,and moral abilities,in order to better protect privacy.
