摘  要:中国古代社会有着数千年的立法、司法经验,“礼刑合一”“礼主刑辅”“疏而不漏”及稳定的法律形式与变通的法律形式相结合,有效地解决了法律与道德、法律与社会及法律与时势的矛盾。以儒家为底色的法律体系,不仅兼容了法家思想,而且连接了历史与现实,使夏商西周的礼治经验与春秋至秦的法治经验得以有效的利用,使王朝确立的主导法思想与社会广泛认可的主流价值观取得了一致,从而有效地保障了社会的长治久安。Ancient Chinese society had thousands of years of legislative and judicial experience.“The unity of rites and punishments”,“rites as the principal and punishments as the secondary”,and a combination of stable and flexible legal forms,effectively resolved contradictions between law and morality,law and society,and law and the trend of the times.The legal system with a Confucian foundation is not only compatible with Legalist thought but also bridges history and reality,which enabled the effective utilization of the experience in the rule of rites from Xia,Shang,to the Western Zhou and the experience of in the rule of law from the Spring and Au⁃tumn period to Qin,made dominant legal ideologies established by dynasties consistent with the mainstream val⁃ues widely recognized in society,and thus effectively ensured long-term stability of society.
