论司法文明传承创新服务全面依法治国的内在机理

摘　　要：明晰司法文明传承创新服务全面依法治国战略的内在机理,是助力推进社会主义法治建设的重要理论命题。二者在追寻严格公正司法的核心目标、人民性的价值基础以及发展性的形成逻辑三个方面存在理念上的融通与契合。除此之外,不断传承与创新的司法文明还能通过强化司法运作中的主体权利本位和促进司法文化中的“情理法贯通”,而提升司法公信力,满足全面依法治国战略在司法领域的工作要求。这表明,司法文明作为法治文明最重要的组成部分,对于助力全面依法治国战略具有重大意义。Clarifying the internal mechanism of judicial civilization inheritance and innovation to serve the strategy of ruling the country in accordance with the law in a comprehensive manner is an important theoretical proposition to help promote the construction of the socialist rule of law.There is a conceptual convergence and fit between the two in the pursuit of the core goal of strict and fair justice,the value foundation of people’s nature and the formation logic of development.In addition,the judicial civilization of continuous inheritance and innovation can also enhance the credibility of the judiciary and meet the requirements of the strategy of ruling the country according to the law in the judicial field by strengthening the subject’s right-based judicial operation and promoting the“emotional,rational and legal coherence”in judicial culture.This shows that judicial civilization,as the most important component of the civilization of the rule of law,is of great significance in contributing to the strategy of ruling the country in accordance with the law in all its aspects.
