大数据背景下行政非诉执行检察监督实证问题研究

摘　　要：行政检察监督重点是以行政诉讼监督为基石,以行政非诉执行监督为延伸,提升行政争议实质性化解质效。而司法实践中,因未有效利用大数据进行分析研判,行政非诉执行检察监督职能作用发挥尚不够充分,主要表现在立法层面、监督体系、监督效能等方面。检察机关应积极研究大数据背景下解决相应问题的对策和措施,依法、全面、有效、智慧实现行政非诉执行检察监督效能,夯实行政检察监督“基石”,为大数据背景下的司法办案实践提供有效遵循。The focus of administrative procuratorial supervision is to improve the quality and effectiveness of substantive resolution of administrative disputes by taking administrative litigation supervision as the cornerstone and administrative non-litigation execution supervision as the extension.However,in judicial practice,due to the lack of effective use of big data for analysis and judgment,the procuratorial supervision function is not fully played,which is mainly manifested in the difficulties and problems in the legislative level,supervision system and supervision efficiency.Procuratorial organs should actively study the countermeasures and measures to solve the corresponding problems under the background of big data,realize the effectiveness of procuratorial supervision of administrative non-litigation execution according to law comprehensively,effectively and intelligently,tamp the cornerstone of administrative procuratorial supervision,and provide effective follow-up for judicial case handling practice under the background of big data.
