应急科普的法律规制:现状特征、实践困境与未来进路

摘　　要：加强应急科普的法律规制,其目的是规范以政府应急科普为主导的各类应急科普行为,发挥应急科普的舆情引导和应急救援科技支撑作用,提升全社会应对公共突发事件的整体效能。目前应急科普法律规制的体系还不够完善,相关法规零散分布在应急管理单行法与部门规章内,无法形成制度合力,导致政府应急科普权责与机制不明确、社会化科普行为管束不严、公众无序参与和信息辨识困难等困境。对此,需要结合实践探索制定《应急科普条例》,明确政府应急科普的领导组织体系和工作流程,并对社会组织以及公众个体的应急科普行为进行分类规范和引导。The purpose of the legal regulation for emergency science popularization is to regulate various kinds of emergency science popularization activities dominated by the government,to strengthen the ability of public opinion guidance and scientific rescue guidance for the whole society s effectively response to public emergencies.At present,China has not a specific law to regulate emergency science popularization because the legal terms related are scattered in many emergency management laws and departmental regulations,which can not play the role of regulation and restriction.It leads to the lack of clear mechanism and responsibilities of the government-leaded science popularization,the lack of regulation and restriction on the social behavior of science popularization,and the people s difficulty in information identifying and choosing.In future,it is necessary to formulate Regulations for Emergency Science Popularization,in order to express organization system and working process of emergency science popularization issued by the government,and to regulate the socialized organizations and public participation behaviors in the light of different conduction.
